Use Of The Service
Semantic Pen offers users the benefit of artificial intelligence to assist with their writing needs. We grant a license to users for individual or commercial use of the Service. This includes incorporating the Service in their own applications or services, provided they are consistent with our terms and conditions.
Payments And Refunds
The service is billed in advance in accordance with our pricing schedule and all monthly and annual payments are nonrefundable. There will be no refunds for partial periods of service or credits used. There will be no refunds for unused service periods or unused credits. At Our discretion, an exception may be made within the first 30-days of service.
Modification And Termination Of Service
Semantic Pen reserves the right to revise or halt the Service, or any part thereof, at any moment without prior notice. We will not be held accountable to you nor any third party for any change, suspension, or discontinuation of the Service.
Limitation Of Liability
Semantic Pen and its affiliates will not be responsible for any damages ensuing from or connected to the use of the Service. This encompasses direct, indirect, incidental, exceptional, penal or consequential damages, regardless of the type of action or the basis of the claim, even if Semantic Pen has been advised about the prospects of such damages. The limitation and exclusion might not apply to you if your jurisdiction does not allow the rejection or limitation of incidental or consequential damages.

Semantic Pen provides no guarantees, neither expressed or suggested, including implied warranties of merchantability and appropriateness for specific usage. We do not warrant the Service to be free of interruptions or errors, and will not be responsible for any disruptions or errors. Content or services from third parties accessible through the Service are not endorsed, warranted, or guaranteed by Semantic Pen.
Fees And Payment
We accept the following forms of payment: Visa Mastercard American Express Discover Apple Pay Google Pay You may be required to purchase or pay a fee to access some of our services. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. We bill you through an online billing account for purchases made via the Site. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in U.S. dollars. You agree to pay all charges or fees at the prices then in effect for your purchases, and you authorize us to charge your chosen payment provider for any such amounts upon making your purchase. If your purchase is subject to recurring charges, then you consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until you notify us of your cancellation. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. We also reserve the right to refuse any order placed through the Site.
Prohibited Activities
You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. As a user of the Site, you agree not to:

- Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “pcms”).
- Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site, or using or launching any unauthorized script or other software.
- Use the Site in a manner inconsistent with any applicable laws or regulations.
Indemnification
You agree to safeguard and hold harmless Semantic Pen, its directors, officers, employees, agents, affiliates, from any claims, damages, losses, liabilities, including fair attorney's fees. This protection is stemming from your use of the Service or any violation of the Terms of Use.
Governing Law
These Terms of Use shall be managed and interpreted by the laws of your governing country India without giving effect to any principles of conflicts of law. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Using the Services for the purpose of providing alerts on disaster scenarios or any other situations directly related to health or safety, including but not limited to acts of terrorism, natural disasters, or emergency response Inappropriate communications Using the services to generate or send unsolicited communications, advertising, chain letters, or spam. Soliciting our users for commercial purposes, unless expressly permitted by Semantic Pen. Disparaging our brand or our partners, vendors, or affiliates Promoting or advertising products or services other than your own without appropriate authorization
Inappropriate Content
Posting, uploading, sharing, submitting, or otherwise providing content that: Infringes Semantic Pen's or a third party’s intellectual property or other rights, including any copyright, trademark, patent, trade secret, moral rights, privacy rights of publicity, or any other intellectual property right or proprietary or contractual right. You don’t have the right to submit Is deceptive, fraudulent, illegal, obscene, defamatory, libelous, threatening, harmful to minors, pornographic (including child pornography, which we will remove and report to law enforcement, including the National Center for Missing and Exploited Children), indecent, harassing, hateful Encourages illegal or tortious conduct or that is otherwise inappropriate Attacks to others based on their race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or medical condition Contains viruses, bots, worms, scripting exploits, or other similar materials Is intended to be inflammatory Could otherwise cause damage to us or any third party In this Acceptable Use Policy, the term “content” means: (1) any information, data, text, software, code, scripts, music, sound, photos, graphics, videos, messages, tags, interactive features, or other materials that you post, upload, share, submit, or otherwise provide in any manner to the services and (2) any other materials, content, or data you provide to us or use with the Services. Without affecting any other remedies available to us, we may permanently or temporarily terminate or suspend a user’s account or access to the services without notice or liability if our company (in its sole discretion) determines that a user has violated this Acceptable Use Policy.
